Welcome to nationalpodcastawardsau.com. These Terms and Conditions (“Terms”) govern your use of our website and your participation in the National Podcast Awards. By accessing this website or entering the awards, you agree to be bound by these Terms.
1. Eligibility
- Location: Participants must be residents of Australia or producing content primarily for an Australian audience (unless otherwise stated in specific category criteria).
- Age: Entrants must be 18 years or older, or have explicit parental/guardian consent to enter.
- Content: Submitted podcasts must be original works and must not infringe on the intellectual property rights of any third party.
2. Award Entries & Fees
- Accuracy: You certify that all information provided in your entry form is true and correct.
- Fees: Entry fees (where applicable) are non-refundable, including in cases of disqualification or withdrawal.
- Deadlines: Entries submitted after the official closing date will not be considered unless an extension has been granted in writing by us.
3. Intellectual Property
- Ownership: You retain ownership of your podcast and any audio submitted.
- License: By entering, you grant the National Podcast Awards a non-exclusive, royalty-free license to use, reproduce, and broadcast snippets of your entry (up to 2 minutes) for promotional and ceremony purposes.
- Media: We reserve the right to use the names, likenesses, and logos of finalists and winners for marketing and press releases.
4. Voting Process
- Voting: All category awards are decided by fan vote. 1 vote per fan per category. The winning podcast has the most votes by 5pm on the 21st of April.
- The major prize, Podcast of the Year, is decided by a panel of independent media experts.
- Finality: The judges’ decisions are final. No correspondence or discussion will be entered into regarding the selection of finalists or winners.
- Discretion: We reserve the right to re-categorise entries if we believe they have been entered into an inappropriate category.
5. Prohibited Conduct
When using this website, you agree not to:
- Submit defamatory, obscene, or unlawful content.
- Attempt to interfere with the website’s security or functionality.
- Use automated bots to scrape data or spam our submission forms.
6. Limitation of Liability
To the maximum extent permitted by law, National Podcast Awards shall not be liable for any indirect, incidental, or consequential damages resulting from your participation in the awards or your use of the website. We do not guarantee that the website will be error-free or uninterrupted.
7. Indemnity
You agree to indemnify and hold harmless National Podcast Awards and its employees from any claims, losses, or expenses (including legal fees) arising out of your breach of these Terms or your violation of any third-party rights.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
9. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website.
